4. Penalty

A proprietor or contractor who fails in his duties under the Regulation
commits an offence and is liable on conviction to a maximum fine of $200,000
and to imprisonment for 6 months.

A registered safety auditor who fails in his duties under the Regulation
commits an offence and is liable on conviction to a maximum fine of $100,000
and to imprisonment for 3 months.

A safety review officer who fails in his duties under the Regulation
commits an offence and is liable on conviction to a maximum fine of $100,000
and to imprisonment for 3 months.

A scheme operator who fails in his duties under the Regulation commits
an offence and is liable on conviction to a maximum fine of $50,000.

Any person who obstructs the Commissioner in exercise of his power
to inspect the conduct of any safety audit, safety review or scheme; or
for the purposes of assessing the performance of a registered safety auditor
or safety review officer to conduct a safety audit or safety review, commits
an offence and is liable on conviction to a maximum fine of $50,000.
