Employees Compensation Assistance Fund Board

The Employees Compensation Assistance Fund Board (the Board) was established on 1 July 1991 under the Employees Compensation Assistance Ordinance (Chapter 365) to administer the Employees Compensation Assistance Fund (the Fund). The Fund provides for the protection of the entitlement of employees and others to compensation for employment-related injury, and for the making of relief payment to eligible persons in relation to common law damages for such injury.

Functions
  1. To hold the Fund in trust and to administer the Fund in accordance with the objects of the Ordinance; 
  2. To receive monies collected from insurers by the Employees' Compensation Insurance Levies Management Board; 
  3. To determine the eligibility of persons applying for payment from the Fund; 
  4. To advise the Employees' Compensation Insurance Levies Management Board from time to time with respect to the amounts required to meet known and anticipated claims against the Fund.

    Membership

    The Board consists of nine members who are appointed by the Chief Executive of the Hong Kong Special Administrative Region. The current term of appointment is from 1 July 2016 to 30 June 2018 with composition as follows:

Important Notes

An injured employee or other eligible persons who fail to receive the compensation or damages entitled after exhausting all legal and financially viable means of recovery from the employer or insurer may apply for assistance from the Fund.

Under section 25B of the Employees Compensation Assistance Ordinance, a person who commences by writ proceedings in respect of a claim for employees’ compensation or damages shall serve a notice of the proceedings to the Board and the insurer (if applicable).  The notice shall be served on the Board by registered post no later than 30 days after the date on which the writ is filed with the Court.  Such notice should be served in writing in a form specified by the Board, signed by the person and accompanied by a copy of the writ.  A person who fails to serve the notice within the statutory 30-day period will not be entitled to any payment under the Ordinance.
